Surrender to Will

Be it remembered that on the twelfth day of April in the year of our Lord One thousand seven hundred and ninety three John Harriott of Great Stambridge in the County of Essex Esquire a Copyhold Tenant of the said Manor came before David Harridge Gentleman Lord of the said Manor at his usual Dwelling house being the Manor house of and belonging to the said Manor called Little [Stambridge] Hall and did out of Court surrender out of his hands into the Lords own hands by the Rod according to the custom thereof All that undivided Moiety or half part (the whole into two equal parts to be divided) of in and to All that piece or parcel of Customary Land containing by Admeasurement One Acre little more or less whereon a Tenement or Building hath been lately erected and built called or known by the Name of the Cherry Tree which said piece or parcel of Land late was part and parcel of Six Acres of Land called Winters lying and being in Little Stambridge aforesaid and holden of the said Manor as the same now are in the tenure or occupation of Thomas Cattell his undertenants or assigns And also One other undivided Moiety the whole into two equal parts to be divided of in and to All that the said piece or parcel of Customary Land containing by Admeasurement One Acre (little more or less) whereon a Tenement or Building hath been lately erected and built called or known by the Name or Sign of the Cherry Tree which said piece or parcel of six acres of Land called Winters lying and being in Little Stambridge aforesaid and holden of the said Manor as the same now are in the tenure or occupation of Thomas Cattell his undertenants or assigns And the reversion and Reversions Remainder and Remainders Rents Issues and Profits of all and singular the said several Moieties of the said premises And all the Estate Right Title and Interest Inheritance Possession Property Claim and Demand both at Law and in Equity of him the said John Harriott of in and to the same and every part and parcel thereof To the only use and Behoof of the said Thomas Cattell of Little Stambridge aforesaid Victualler his heirs and assigns absolutely and for ever according to the Custom of the said Manor Who being now personally present humbly prayed of the Lord of the said Manor to be admitted Tenant to all and every the Land and Tenements parts and shares of Lands Tenements and Hereditaments comprized and mentioned in the aforesaid Surrender To which said Thomas Cattell the Lord of the said Manor of his special grace and favor did out of Court by his own hands grant and deliver Seizin thereof by the Rod To have and to hold all and singular the said Premises with the Appurtenances unto the said Thomas Cattell his Heirs and and Assigns for ever of the Lord by the rod at the will of the Lord according to the custom of the said Manor by the rents customs and services therefore antiently due and of right accustomed and he gave to the Lord such ffine as appears in the margin and saving to the Lord all Rights he is admitted Tenant thereof in fform aforesaid and did his ffealty

And immediately afterwards the said Thomas Cattell did out of Court surrender unto the hands of the Lord of the said Manor by his own hands and acceptance All and every the Messuages Lands tenements and Hereditaments of him the said Thomas Cattell holden of the said Manor by Copy of Court Roll To and for such Uses Estates Intents and purposes as in and by the last Will & Testament of the said Thomas Cattell in writing already made or hereafter to be made is or shall be thereof expressed and declared
