The Will of Valentine Linggood of Hockley, 1819

Made 21 October 1815, Proved 31 August 1819

In the name of God, Amen I, Valentine Linggood of Hockley in the County of Essex of sound mind and memory do hereby revoke all former wills and testaments by me made and declare this to be my last will and testament first resign my soul to the Creator humbly hoping for its happiness as in the disposal of a being in finately good and I give and devise to Ann my wife all the stock in trade and all book debts belonging to the same whatsoever or whosoever it may be found she shall not be interrupted upon any account whatsoever and Ann my wife to have her third part of my Estate being and lying in the parish of Rayleigh in the County of Efsex and further my will is that she shall pay all Bills and Contracts as shall be made or charged upon the same mentioned business and if that she makes any refusal in paying the same Executors herinafter mentioned shall enter the premises and make sale of the stocks in trade and household goods and chattels to me belonging and pay all amounts that may be made upon the same and in case that Ann my wife should be out of business my Executors shall have the Liberty of paying the same out of her third part of the Estate above mentioned without interruption from her that is meaning Ann my wife and further my will is that all that messuage situated in the parish of Rayleigh aforesaid wherein now lives John Loten Noone, John Bell, David Harridge, and Valentine Linggood with the Blacksmiths Shop yard and gardens thereto belonging as the same is or now occupied and is further my will is that my Executors hereafter mentioned shall at the Expiration of two years after my decease shall duly auction my said messuage and all the other possessions last mentioned with their appartuances and my will is that the profit and recipts of my Executors or the surviviors of them or their Executors Administrators I give trust that all money or monies be to be given for the purchase or purchase's of the said mefsuage and premises with their appertuances or any part or parts thereof shall be good valid discharge for the same at Law in Equity and that such purchaser or purchasers shall not be accountable any further for such consideration money or monies to any person or persons whomsoever for any cause or reason whatsoever and my will is that he Rent arising from the aforesaid mefsuage until the Term of ten [or two] years are expired after my decease to be paid to Ann my wife then the whole of the premises to be sold by auction as before mentioned I will and bequeath to Thos Linggood the sum of Thirty pounds to John Linggood thirty pounds to Valentine Linggood thirty pounds to Ann Linggood sixty pounds to Elizabeth Hunt Noone sixty pounds to William Linggood sixty pountds all my Sons and Daughters and the above said sums to be paid out of the money that shall arise out of the money arising from the aforesaid premises and my will is that if the money arising from the aforesaid premises should be more than is bewilled it shall be equally divided between aforesaid persons and if it should be less than is mentioned they are to take it equally in proportion without any trouble whatsoever and my will is that Ann my wife shall keep or cause to be kept the aforesaid messuage tenantable repairs out of the aforesaid two years rent and if either of my sons or daughers die before the estate is sold his or her part to be equally divided to either of the rest of my children then living without any deduction whatsoever only paying part of their expenses from the sale of the estate I order my Executors herinafter mentioned or the survivors of them or their Executors or Administrators and the money arising from the sale or sales of the aforesaid mefsuage to be approved and paid as before decided and I make and ----titute and appoint William Linggood Linen Draper of Cirencester in Gloucester and John Loten Noon saddler in the parish of Rayleigh and Thos Linggood jobing smith in the parish of Rayleigh aforeseaid my executors of this my last will and testament and the money arising from the sale or sales of the aforesaidmefsuage and Blacksmiths Shop and the appertuances therunto belonging to be paid and assigned as before men tioned after the payment of my funeral expences and probate of this my last will and testament and all the expenses belonging to the same and I give and bequeath to Ann my wife all the household furniture goods and chattles in witness therefor I the said Valentine Linggood the testator named to this first sheet of this my last will and testament contained in two sheets of paper set my hand out to this my last sheet set and put my hand and seal this 21st day of October in the year of our Lord one thousand eight hundred and fifteen. Valentine Linggood signed sealed ------- and declared by the said Valentine Linggood the testator as and for his last will and testament in the presence of us who in the presence at his request in the presence of each other have indicated our names witness thereto   -- George Hart, Sarah Hart, Elizabeth Hunt.

On the thirtyfirst day of August in the year of our Lord one thousand eight hundred and nineteen before the Reverand Thomas Robert Cates Surrogate ---- by, the Oath of Thomas Lingwood the son and John Loten Noon the surviving Executors to whom administration was granted they being first sworn duly to administer.
