The Will of Charles Clark Noone, 1840

In the Name of God Amen I Charles Clark Noone of Rayleigh in the County of Essex Printer and Hair Dresser being at the time of making the same of sound and perfect memory and understanding thanks be to Almighty God for his manifold Blessings and mercies to me First I desire to be decently buried in the Church Yard of Rayleigh aforesaid as near as may be to where my deceased parents are interred and that my Funeral shall be conducted without any unnecessary expense And I give & bequeath to my executors hereinafter named my Freehold Dwelling House Workshops Yard Garden and Premises situate at Rayleigh aforesaid and in which I now reside and carry on my Business together with the Appurtenances thereunto belonging upon trust for them to let the same on Lease or other wise to such person or persons as they may think most beneficial to my Estate and I direct that out of the rents and profits thereof they do pay or allow to Eleanor Noone Widow of the late John Noone lately living at Prittlewell in the County of Essex and now residing with me the sum of Fifteen pounds a year payable half yearly for and during the term of her natural life so long as she shall continue a Widow and unmarried without any deduction or abatement whatsoever and should there be any residue of such rents and profits beyond the said sum of Fifteen pounds after paying all Taxes Insurances and Repairs then I direct my executors to pay the same from time to time among my Brothers and Sisters hereinafter named in equal shares and proportions and at the decease or marriage of the said Eleanor Noone then I direct my Executors within three months or so soon as conveniently may be afterwards to sell and dispose of my said Freehold House Shop and Premises and divide the produce thereof equally among my Brothers and Sisters hereinafter mentioned for their absolute use and benefit   And I also direct my Executors to collect in my Outstanding Securities for money and my Steam Packet share and all my debts and within one month after my decease to sell and dispose of by Public Auction or Private Contract all my stock in Trade Printing Presses Type Stationery Implements and Fixtures Household Furniture Linen Glass and All other Property whatsoever and wheresoever and of what nature or kind soever that I may die possessed of (save what I may hereafter mention) and that they do divide the produce of such sales after the payment of all my just debts and Funeral and Testamentary expenses amongst all my Brothers and Sisters namely John Loten Noone Frederic Crisp Noone Elijah George Noone Elizabeth Clark Gates and Violetta Sarah Rand or such of them as shall be living at the time of my decease share and share alike But in case of the death of any or either of them previous to my decease then I give the share of shares of such deceased Brothers or Sisters including the produce of my Freehold House and Premises amongst their Children to be equally divided between them if any and if no Child or Children then give the same among my surviving Brothers and Sisters hereinbefore mentioned  And I give and bequeath to Eleanor Noone the Wife of my late Father before mentioned the picture of the Happy Family a Feather Bed Bolster and Pillows Blankets sheets and Coverlet Bedstead with the Furniture and Mattress Circular Chest of Mahogany Drawers 3 Chairs Washhand stand Looking Glass blue Clothes Chest Pembroke Table best Carpet for Room Set of Fire Irons Tea kettle Box Iron and Heaters Set of Tea Service 3 silver Tea spoons One silver Table D[itt]o Plates Dishes Wash Tub Pail and such other Articles to furnish a small Dwelling as my said Executors shall think proper and needful And I give and bequeath all my Wearing Apparel and Body Linen and all my silver Gravy Table Tea and all other Plate to my aforesaid Brothers and Sisters or such of them as shall be living at the time of my decease share and share alike And I hereby nominate and appoint Frederick Crisp Noone Cordwainer of Southminster James Tyrrell of Hadleigh Essex and Charles Trapps of Epping Essex my Executors of this my Will And I order and direct that my said Executors shall and may deduct and reimburse themselves all such reasonable Costs Charges and expenses as they or either of them may sustain suffer or be put unto on Account of the execution and performance of this my Will nor shall the one of them be answerable or accountable for the Acts Deeds or misconduct of the other but each for his own Acts and Deeds only & hereby revoking all and every other Will and Wills by me heretofore made do declare this and this alone to be my last Will and Testament In Witness whereof I have hereunto set my hand to the two first sheets thereof and my hand and seal to the third and last sheet thereof this eighteenth day of November in the year of our Lord One thousand eight hundred and thirty four – Charles Clark Noone – Signed sealed published and declared by the said Charles Clark Noon in the presence of us who in his presence & in the presence of each other and at his request have signed our names as witnesses thereto – Valentine Linggood – William Pissey – James Pearse Proved at London with a Codicil the 18th July 1840 before the Worshipful Augustus Frederick Bayford Doctor of Laws and Surrogate by the Oaths of Frederick Crisp Noone the Brother James Tyrrell and Charles Trapps the Executors to whom Admon was granted having been first sworn duly to administer.

A Codicil to be annexed to and taken as part of the last Will and Testament of me Charles Clark Noone of Rayleigh in the County of Essex Printer I give and devise unto Eleanor Noone Widow of John Noone Hair dresser late of Prittlewell in the County of Essex and who is now residing with me [interlined] All that my freehold messuage or tenement hereditaments and premises situate lying and being in the parish of Leigh in the County of Essex late in the occupation of [Blank] Gurnett but now in the occupation of Thomas Steward to hold the same unto the said Eleanor Noone for and during the term of her natural life   And from and after her decease I do hereby give and devise the said messuage heredits and premises unto my Nephew Charles Noone Son of my Brother John Loten Noone of Rayleigh aforesaid to have to hold to him the said Charles Noone his heirs and assigns for ever And in all other respects I confirm my said Will bearing date the eighteenth day of November One thousand eight hundred and thirty four and declare the same with this codicil to be and contain my true & last Will and Testament In Witness whereof I have hereunto set my hand and seal this ninth day of January One thousand eight hundred and thirty nine – Charles Clark Noone – Signed sealed published and declared by the said Testator as and for a Codicil to his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our name as witnesses the interlineation being first made, Nevill Lloyd Syers Rayleigh – Samuel Count Rayleigh – Thomas Scudder Rayleigh.
